Defending CONSUMER RIGHTS

Alongside Mario Barletta presented in yesterday, our proposal on the rights of the consumer. We believe that the current management on behalf of consumers is a pending current government, there was no progress on the issue and we are in the same conditions as the first day in office.


The rights of consumers and users is in Santa Fe, a state policy. Proof of this is that if we look at the website http://www.santafe.gov.ar/ is extremely difficult to find the Directorate General of Domestic Trade, authority of 24,240 law enforcement in our province. Furthermore, provincial authorities have not changed the conditions of public service users in cases like the provincial water company ASSA, and especially in the case of the SLR which continues to govern internal regulations dating from the 60's and absolutely violates all laws and regulations protecting consumers. It seems that in this area, as in many others, we feel an absence of state and who should care for the rights of consumers, who are all citizens.

We raise a government where the area police exercise power on behalf of the provincial state laws regarding the Consumer Protection Fair Trading, Credit Cards, and Competition, all members of the legal system rules Argentine in the field. Besides, the substantial change is the delegation of authority to apply such laws to municipalities enabling them to farm violations and to initiate proceedings.

The inicitiva also includes the creation or training of a corps of inspectors to monitor the implementation of standards in the municipalities. We must raise the rank of Secretary of State to the current Directorate of Internal Trade by operating under the aegis of the Ministry of Government, considering that consumer rights should be classified as third generation human rights.

In terms of consumer rights, we need a thorough reform that gives new tools to citizens to exercise their rights more effectively and to involve a more active engagement of the State in the matter.

Our proposal includes the following measures:

1) Transform the Directorate General of Domestic Trade in a Ministry of the Rights of Users and Consumers of the Province of Santa Fe, placing it within the orbit of Ministry of Government. These rights are not commercial in nature, but third-generation human rights and constitutionally protected and must interpret them and ensure their effective state;

2) The Secretary shall exercise police power on behalf of the provincial government on of Consumer Protection Laws 24,240, 22,802 of Fair Trading, Credit Card 25,065 and 25,156 Competition, which together constitute the entire hermeneutic system of Argentine law on the subject;

3) delegate authority for implementation of the laws referred to the municipalities, who will sign relevant agreements with the Secretariat for the purpose of acting concurrently in the exercise of their functions. In the same direction to enable municipalities to plow violations and to initiate proceedings for breaches to verify in the field of competence, of the aforementioned regulations;

4) Creating a corps of inspectors from a call of the current officers of the provincial government for the purpose of exercising the police power of the four laws mentioned in the five decentralized nodes in the province, officially and for the purposes of preventing violations of the rights of consumers and users and can initiate without complaint from relevant proceedings;

5) Creating and training by the provincial government, of a similar corps of inspectors in each of the municipalities to adhere and agree to be implementing authority, in order to monitor the effective application of these rights;

6) In parallel with these reforms in the first 100 days in office will forward to the provincial legislature a bill for the purpose of punishing a code of implementation at the provincial level of the whole system of law users and consumers. The same shall cover the following aspects: a) policies to protect users and consumers; b) consumer access conditions and fair treatment without discrimination and, c) fair and effective competition; d) the effective protection of health and safety of consumers, e) quality control and equity products, goods and services, fair trade practices and contract terms and veracity of the information and commercial advertising; f) to encourage sustainable consumption, g) an efficient and rigorous control of public services, ensuring users access to consumption and distribution very efficient, the actual extent of services to all sectors of the population and the quality of their delivery, control monopolies, preventing the recovery of improper concepts, ensuring fairness in pricing and tariffs, and an effective and rapid mechanism for receiving complaints and customer services; h) education and information to consumers and users, and its organization i) the regulation of an administrative procedure aimed at preventing and resolving conflicts as well as screening, testing and penalties for violations and breaches, j) ensuring effective access for users and consumers to justice Through a quick and free.
